Welcome - Thank you for visiting Adam Health. These Terms of Use govern your use of our website located at https://talktoadam.com (the “Site”).  

Adam Health Ltd, a company registered in England and Wales with company number 09789580, is the operator of this Site. Our registered address is 78 Seymour Place, London, England, W1H 2EH.  

Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

Quick note: these Terms cover the Site only (content, public pages, tools and features). Separate agreements govern purchases, product use and how we handle personal data - see our Terms & Conditions and Privacy Notice on the Site for those details. Use of the Adam Sensor and the Adam Health App is governed by separate Adam Sensor App Terms & Conditions that you must read and accept before you use the Sensor or App.

1. Who we are

Adam Health Ltd operates this Site. We provide information about our products and services and make certain online tools available to visitors.

2. Definitions (short & simple) 

  • Site: https://talktoadam.com and the pages and public features you access there.

  • App: Adam Health mobile application (governed by separate App terms).

  • Sensor: the Adam Sensor device.

  • Content: text, images, video, graphics and other material on the Site.

  • User Content: anything you post publicly on the Site (reviews, comments, feedback).

3. Eligibility and age

You must be at least 18 years old to use the Site. By using the Site you confirm you are 18+ and able to accept these Terms.

4. Site access and availability (what to expect)

We try to keep the Site available and working, but we can’t promise it will never be down or error-free. Access depends on many things - your device, your internet provider, and third-party services we rely on. We may need to suspend or change the Site for maintenance, security, or operational reasons. When possible we’ll try to warn you about major interruptions, but we can’t promise advance notice in every case.

5. Use the Site responsibly (our simple rules)

Please use the Site lawfully and respectfully. Don’t: 

  • post anything illegal, defamatory, abusive, obscene or invasive of privacy;

  • attempt to gain unauthorised access to our systems or other users’ accounts;

  • use scraping tools, automated bots, crawlers or excessive automated requests without our written permission;

  • upload malicious code, viruses or anything that harms the Site; or

  • impersonate anyone or misrepresent your affiliation.

If you break these rules we can remove your content, suspend your account, block your access, or take other steps.

6. Accounts, passwords and security

Some features require an account. Keep your password safe and don’t share it. You’re responsible for everything that happens under your account. If you suspect unauthorised access, change your password and tell us right away - we’ll help secure your account.

7. Device identifiers and sign-in (onboarding)

To make sign-in easier and more secure, we may store a device identifier after you verify your email with a one-time password (OTP). This device identifier is required to verify that a login attempt is coming from a recognised device as part of the security and authentication systems. For this reason, it cannot be opted out of or removed. If no device ID exists or 30 days have passed, we may ask you to re-verify to establish a new trusted link. 

8. Posting reviews, feedback and other public content

If you post reviews or public feedback, you grant Adam Health a perpetual, worldwide, royalty-free licence to use that content for the Site and our business (including marketing). Don’t post sensitive personal or health information in public comments. If you ask us to remove public content, we will try to do so promptly, subject to technical limits and legal obligations.

9. Intellectual property - what you may and may not do

All Site content is owned by Adam Health or licensed to us and is protected by IP laws. You may view, print or download Content for personal, non-commercial use only. You may NOT copy, reproduce, distribute, publish, modify or commercially exploit Site content without our written permission.

10. Links to third-party sites

The Site may link to third-party websites, services or research. Links are provided for convenience and do not imply endorsement. We are not responsible for the content or practices of third-party sites.

11. Cookies and tracking (short reference)

We use cookies and similar technologies. See our Cookie Policy for categories, consent and how to manage preferences. Essential cookies are required for the Site to work and cannot be disabled without affecting core features.

12. Accessibility and reasonable adjustments

We aim to make the Site accessible. If you need content in a different format or face difficulty using the Site, contact support and we will try to help.

14. Warranties and disclaimers (an honest heads-up)

The Site and its Content are provided “as is” and “as available.” To the fullest extent permitted by law, Adam Health makes no warranties about the accuracy, completeness, or reliability of the Site or Content and does not guarantee uninterrupted access.

15. Limitation of liability - what we are and aren’t responsible for

To the maximum extent permitted by law, Adam Health and its staff are not liable for any loss or damage arising from your use of the Site, including indirect, consequential, special or punitive losses (e.g., lost profits or lost data). This does not affect liability that cannot be excluded by law, such as for death or personal injury caused by our negligence.

Where law does not permit exclusion, our aggregate liability for direct losses caused by our breach of these Terms is limited to £100 or any higher amount required by mandatory consumer protection law.

16. Indemnity - if you cause us loss

If a third party makes a claim because of something you did (for example illegal content you posted or other misuse of the Site), you agree to cover our reasonable losses and legal costs arising from that claim.

17. Suspension, restriction and termination

We may suspend or terminate your access to the Site if you breach these Terms or for operational, legal or security reasons. When possible we will explain why and how to resolve the issue. On termination we may delete or block your account and User Content in line with our retention policies and legal obligations.

18. Force majeure - events out of our control

We won’t be liable for failure or delay caused by events beyond our reasonable control (natural disasters, strikes, pandemics, major internet outages, or government actions).

19. Export controls and sanctions

You must comply with applicable export, import and trade sanctions laws. Do not use the Site in a way that would breach those laws.

20. Notices and electronic communications

We may communicate with you by email or through the Site. Notices to us should be sent to support@talktoadam.com. Electronic communications are considered written notices.

21. Adam Sensor App Terms & Conditions

Use of the Adam Sensor device and the Adam Health App is governed by separate Adam Sensor App Terms & Conditions. These Site Terms do not replace or override those App Terms. Before you use the Sensor or App you must review and accept the Adam Sensor App Terms & Conditions; if you don’t accept them, you may not use the Sensor or the App. Where a conflict exists between these Site Terms and the App Terms, the App Terms govern use of the Sensor and App, while these Site Terms govern your use of the Site.

22. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will post the revised Terms on the Site with a new “Last updated” date and, where required by law, notify you. Continued use of the Site after changes indicates your acceptance.

23. Severability and entire agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in force. These Terms, together with any policies referenced (Privacy Notice, Cookie Policy), form the entire agreement between you and Adam Health regarding your use of the Site.

24. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer protection laws where you live, disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
